Environment Protection and Biodiversity Conservation Amendment (Reconsiderations) Bill 2025

The CHAIR (22:06): I will now deal with the remaining Committee of the Whole amendments, starting with further amendments circulated by the opposition on sheet 3339. The question before the committee is that the amendments on sheet 3339, standing in the name of the opposition, be agreed to. Opposition's circulated amendment s — (1) Schedule 1, item 1, page 3 (after line 24), after subsection 78(3A), insert: (3B) The Minister must not revoke the first decision if: (a) the first decision was that the action was a controlled action; and (b) the action is being taken; and (c) either: (i) if the Minister is requested under subsection 78A(1) to reconsider the decision—at the time the request is made, the way in which the action is being taken has been ongoing or recurring for at least 5 years; or (ii) otherwise—the way in which the action is being taken has been ongoing or recurring for at least 5 years.

(2) Schedule 1, item 2, page 3 (line 28), omit "78(3) or (3A)", substitute "78(3), (3A) or (3B)".
