Senator KOVACIC (New South Wales) (12:02): I understand that that's the function of the commission and that their purpose or job is to weigh up evidence and apply discretion. But how are they going to be able to do that now based on this legislation—because this has now become prescriptive? It actually can't say, 'Weighing up the balance of things, this is fair and reasonable.' They're actually being told, 'We actually have to do this.'
