Fair Work Amendment (Protecting Penalty and Overtime Rates) Bill 2025

Senator KOVACIC (New South Wales) (19:04): This is another question that came through in the inquiry. If a penalty or overtime rate itself remains unchanged but the circumstances in which it's applied are narrowed, would that be treated as a rate reduction under proposed section 135A(1)(a)? In other words, if the hours of work change but the rate doesn't change, will the bill see that as a reduction?
