Senator DAVID POCOCK: I move: That there be laid on the table by the Minister representing the Minister for Aged Care and Seniors, by no later than midday on Tuesday, 8 September 2026, copies of: (a) all documents referenced in Auditor-General's report no. 37 of 2024-25, Administration of the Future Fit Program (FFP), including: (i) all versions of the Mid-Point Check (MPC) report, including the version stating 'the Meals Marketplace Pty Ltd will take responsibility for and manage the design and development of FUTURE FIT technology and will own the IP in FUTURE FIT technology', (ii) all correspondence (and attachments) discussing the MPC reports, (iii) the Customer Relationship Management (CRM) software tool proposal that informed Official Order 2, and (iv) budget phasing documents for Official Order 2; (b) the document titled 'Official Order—Miles Morgan Australia Pty Ltd MMA edits 08 JULY 2022.docx'; (c) any communications, papers, proposals regarding the Information Technology (IT) CRM tool being proposed, including any requests for funding this tool prior to Official Order 2; (d) the document titled 'Official Order—Miles Morgan Australia Pty Ltd—FUTURE FIT—MMA—29 September 2022.docx' and all other drafts of that Official Order; (e) any document titled 'Future Fit—Key Deliverables.pdf'; (f) all documents itemising the deliverables and acceptance of deliverables related to Official Order 2; (g) all documents discussing a variation to contract notice CN4036947, in relation to 'Transitioning the Whitehorse Meals on Wheels operations to Newcastle Meals on Wheels' including any advice sought and any documents recording Miles Morgan Australia's refusal to agree to the proposed revised terms; (h) all internal briefing papers, documents and status updates that were produced as a result of the Department of Health, Disability and Ageing's (the Department) contract management of the FFP, prepared between 1 December 2021 and 30 June 2024 inclusive; (i) all internal audits, reviews, and investigations, conducted by the Department, relating to intellectual property in the customised software used by the FFP, from 1 November 2023 until the date of this order inclusive; (j) all correspondence discussing the customised software used by the FFP and intellectual property related to that software during December 2023; (k) all correspondence between the Department and representatives of the Future Fit Collective Ltd in relation to the sale or transfer of intellectual property in the customised software used by the FFP to the Future Fit Collective Ltd for the sum of $1; (l) all correspondence recording or describing the Department's intention for the customised software used by the FFP to be provided to a suitable Meals on Wheels entity that would assume ownership and responsibility for the customised software (including its hosting and ongoing maintenance); (m) all correspondence, agreements and file notes recording the Department's agreement to transfer or assign the customised software used by the FFP to any organisation; (n) all documents, including correspondence, communications, legal advice and risk assessments relating to the publication of the source code of the customised software used by the FFP on GitHub, or to any other public repository, including any assessment of intellectual property ownership, confidentiality implications or third-party rights conducted before or after publication; and (o) the list of lessons learned in administering the FFP across the following themes: procurement and contract management; intellectual property; risk management; deliverables; and communications and relationships, as provided to the Australian National Audit Office.
