What's being proposed is that the Attorney-General make an authorisation, given the importance of the powers and functions, to ensure that the identified conflict of interest is adequately managed.

I'm sure you would agree that that's an appropriate thing for the Attorney-General to do, but it does not in any way interfere with the independence of the agency. It would not be appropriate for the director to use their power of delegation to delegate the performance of the relevant function or exercise of the relevant power in circumstances where they have identified a conflict of interest.
