Senator GREEN (Queensland—Assistant Minister for Tourism, Assistant Minister for Pacific Island Affairs and Assistant Minister for Northern Australia) (10:35): As outlined in the explanatory memorandum, the Attorney-General may authorise a person to perform or exercise the relevant functions or powers if the person is: a member of the staff of the CDPP an APS employee who is classified as a Senior Executive Service Band 2 or an equivalent or higher, or acting as such, and a legal practitioner.

This ensures the authorised person is of sufficient seniority to exercise powers … that would otherwise be vested in the head of the agency. And, to be clear: … an authorisation may authorise a person to perform a function or exercise a power in relation to specified proceedings, specified acts or omissions, or in specified circumstances. It also provides that the authorisation can authorise a person to perform a function or exercise a power under the act.
