The DEPUTY PRESIDENT (15:39): I'll now deal with amendments circulated by One Nation. The question is that amendments on sheet 4121 be agreed to. One Nation's circulated amendment— SHEET 4121 (1) Clause 2, page 2 (table item 2), omit the table item, substitute: 2.
Schedule 1, Parts 1 to 11 other than item 5A and item 5B The 28th day after this Act receives the Royal Assent. 2A. Schedule 1, item 5A 26 September 2002. 26 September 2002 2B. Schedule 1, item 5B The day after this Act receives the Royal Assent.
(2) Schedule 1, page 4 (after line 11), after item 5, insert: 5A Dictionary in the Criminal Code (definition of hors de combat ) Repeal the definition, substitute: hors de combat: a person is hors de combat if: (a) the person is in the power of an adverse party; and (b) the person: (i) clearly expresses an intention to surrender; or (ii) has been rendered unconscious or is otherwise incapacitated by wounds or sickness and is therefore incapable of defending himself or herself; and (c) the person abstains from any hostile act and does not attempt to escape. 5B Application provision (1) The definition of hors de combat in the Dictionary in the Criminal Code, as inserted by this Part, applies in relation to: (a) any conduct engaged in on or after 26 September 2002; and (b) any legal proceedings that are commenced on or after that day, if the proceedings have not been finally determined before the commencement of this item.
(2) In this item, legal proceedings include any proceedings before a court or tribunal, and include proceedings that are pending.
