Senator KOVACIC (New South Wales) (16:01): At the request of Senator Ruston, I move: That the Senate— (a) notes that: (i) on 9 September 2026, the Senate agreed to an order for the production of documents, order no. 666, requiring the Minister for Aged Care and Seniors to provide documents relating to the number of people who died while on the National Priority System waiting list for a Support at Home or Home Care package during 2025-26 financial year, (ii) in response to the order, the minister advised that the scope of the searches required to comply with the order was expansive and that it was not possible to achieve compliance within the timeframe, but did not provide a date by which the documents would be produced, and (iii) the minister further advised that the data sought by the order is still undergoing validation, despite the order not requiring the provision of validated data; (b) notes that the order has not been complied with; and (c) requires the Minister representing the Minister for Aged Care and Seniors to attend the Senate on Thursday, 17 September 2026 at the conclusion of private senators' time to provide an explanation no more than 5 minutes of the failure to comply with the order, and that: (i) any senator may move to take note of the explanation, (ii) any such motion may be debated for no longer than 30 minutes and shall have precedence over all business until determined, and (iii) senators may speak for not more than 5 minutes each.
